By using or submitting an order in this website, you are agreeing to the terms that appear below. So please read the below terms and conditions carefully.

To register with KERALI Restaurant & Bar you must be 18 years of age or over.

Online Orders

This website is operated by KERALI ELLYXSIAN RESTAURANT  & BAR (“we”, “us” or “our”), BRN I17000327 . By using Keraliresto.com website you are bound by these Terms & Conditions. If you use or order foods after we have published any changes you will be bound by those changes. Accordingly, you should check prior to each use or order to ensure that you understand the precise Terms & Conditions.

We will confirm your order whether placed directly by using Keraliresto.com website or as a result of your request online reservation. This will occur either by Email on the website immediately after you have confirmed your order, or by sending an email to the email address you have provided to us.

Please note that the order confirmation does not constitute our acceptance of your order. Subject to our cancellation rights in clause “Unpaid orders”, acceptance of your order and completion of the contract will take place when we received full payment.

You must be 18 years old or over and must have completed the registration process in order to participate in our service.

The law places certain restrictions on transactions involving alcohol, and accordingly alcohol must be either ordered on the spot  and consumed while dine-in or request take-away only by an adult during normal licensing hours. If you have ordered alcohol with glass option from us before arrival. Please note that you’ll be served at the bar directly. It is your responsibility to ensure that payment is made before you arrive to pick up the order and all order are checked correctly before completing your orders.

Pick UP – Take Away

When you choose to pick up an order placed online; No Cash on delivery permitted; to avoid unattended dishes. A Lot of food was wasted due to unattended orders. All orders shall be paid via bank transfer or Juice Pay via MCB– If Bank transfer is still in process; we recommend you to share a screenshot with the transaction reference number on 59208667 via WhatsApp. Your order is sent to Kitchen and prepared only when we receive the full payment of the order.

Reservation – Same day Dine-In

You may Order your dishes online and request a table Reservation to Dine-in. This will save you a lot of time and you wont have to wait to get served. While ordering online You’ll have to choose a time with Pick-up Option – This option is used to Reserve a table also. Use the instruction box below; at the checkout page; add the mention “Order to Dine-In” and our team will handle the rest.

Opening Hours

Note We Remain CLOSED EVERY TUESDAYS and Closed from 14:00 till 18:00PM during the week. Orders that are processed on Tuesdays or during the closed hours will not get prepared and thus be undelivered even if the scheduling time is available while ordering.  If ever order has been paid; no refund is applicable. Instead you may opt for any other date of your choice, to collect or consume for the amount you have been paid for; with a validity of 1 week. (For accounting purposes.). For that, we recommend customers to keep their order invoice confirmation and bring the order reference number on chosen pick-up date or reservation date.

Forms of Payment

Payments must be done using Bank Transfer to our account or though MCB Mobile Number JUICE PAY. We encourage you to pay for your order directly after placing it to ensure timely processing  & to get it ready for take-away; on chosen time; when ordered. Please note that unpaid orders will not be prepared, thus not sent to the kitchen for preparation. If Bank transfer is still in process at the time you made it; we recommend you to share a screenshot of the transaction reference number on 59208667 via WhatsApp. Your order is sent to Kitchen and prepared only when we receive the full payment of the order. Sending and screen shot as proof may help us proceed with your order quickly while your transaction is beign process via your bank.

Warranty & Liability

Nothing in these Terms & Conditions will restrict our liability for death or personal injury resulting from our negligence, breach of contract or breach of statutory duty, nor will any of these terms restrict any of your statutory rights. In addition to paragraph 4.4, we will not be deemed to be in breach of contract of of these Terms & Conditions as a result of any delay in our performance or failure to perform our obligations if that delay or failure to perform is due to any cause or circumstance beyond our reasonable control including, but not limited to, fire, flood and other acts of God, strikes, riot, accident, disruption to energy supplies, civil commotion, acts of terrorism or war, breakdown of equipment, road traffic problems.

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.

We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.

You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall Kerali Restaurant & Bar, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law

Our maximum liability arising out of any order for the delivery of foods to you under this contract will be limited to the retail price of the foods contained in that order.

SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

You agree to indemnify, defend and hold harmless Kerali Restaurant & Bar and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

Privacy

To help us ensure the best possible service a real valid email is required so we can send your invoice of your order. We respect your privacy. The personal information that you give us is held with care and security. We do not sell, rent or transfer this information to third parties for their marketing purposes. 

At the time of your registration you will be required to create a password. Please keep this secret, as you are entirely responsible if you do not maintain the confidentiality of your password. You are entirely responsible for all orders placed with us or information given to us under your email address in combination with your passport. You must immediately notify us of any unauthorized use of your email address and/or password or any breach of security known to you.
